With over two decades of litigation-based and transactional legal experience, Attorney Andy Adamek employs a pragmatic, client-centered approach to legal problem-solving. He counsels and defends employers in employment -related lawsuits, insurance providers in liability disputes, private landowner clients in real estate transactions, land use and zoning and partition actions, and insured and self-insured employers in workers’ compensation matters. Andy also provides general legal counsel and corporate governance services to public housing authorities as well as litigation services in defending fair housing and discrimination in housing, premises liability, and landlord/tenant disputes including evictions.
Employment Defense and Counseling
As an employment defense and counseling attorney, Andy advises businesses and their insures on all facets of employment and workplace matters, from performance and disciplinary counseling to separation from employment to defending wrongful discharge suits. Andy has investigated and defended discrimination and harassment complaints and advised employers in grievance procedure compliance, and has defended numerous suits arising from employment practices liability coverages. Andy is known for delivering experience-based strategic guidance necessary to effectively and efficiently defend and resolve workplace disputes.
Andy’s real estate practice is focused on effectively tackling both routine and complex real estate disputes and transactions for developers, small and large land owners, farmers and ranchers. He has extensive experience in commercial and residential real estate legal matters, including those involving leases, home and condo association services, construction and contractor agreements, land use and subdivision development, zoning, partitions, easements, and road and access disputes.
Workers’ Compensation Defense
Andy represents self-insured and traditionally insured employers and insurance companies in workers’ compensation defense matters. His clients include healthcare facilities and professionals, big-box retailers, and private entities. He also works with third-party administrators in servicing their in-state workers’ compensation accounts.
It is vital for businesses and insurance companies to have a voice before the legislature. Andy provides governmental affairs guidance and advocates on behalf of workers’ compensation clients before the Montana legislature and interim sessions.
Public and Indian Housing and Landlord/Tenant Disputes
Andy has served as general counsel for the Helena Housing Authority since 2008. In this capacity, he provides a wide spectrum of general corporate counsel services involving low income and public housing redevelopment, fair housing matters, landlord/tenant law, and corporate governance.
Andy provides insurance companies and their insureds, insurance service organizations, and self-insured businesses with comprehensive, efficient, and tenacious litigation representation. From pre-suit investigation through appeals, he guides clients through every step of the process, working to expeditiously resolve disputes and minimize liability.
Andy hails from a California farming family, and spent his young adult life in the Atlanta area. He received his undergraduate degree from the University of Georgia and a law degree from the Walter F. George School of Law, Mercer University. He then worked in Atlanta for five years, focusing on workers’ compensation and premises liability defense. He relocated to Helena in 1998 in pursuit of the Rocky Mountain lifestyle.
Andy and wife Marika have raised two children in Montana. In his free time, he enjoys maintaining an active outdoor lifestyle, cycling, retriever dog training, and coaching, playing and officiating soccer.
