Mr. Auerbach is the chairman of BKBH’s Healthcare Law Practice Group. Relying upon his upbringing in a medical family, he has developed his skills and expertise in healthcare law for more than a decade. Dan’s healthcare work involves all aspects of the field, including risk management, state and federal regulatory issues, healthcare information privacy, provider contracting, employment claims, compliance assessments, and general litigation. He has represented clients a variety of settings including administrative proceedings and court litigation involving electronic health records systems, malpractice claims, physician contracts, state and federal reimbursement claims, and Medicare and Medicaid fraud. Mr. Auerbach also leads BKBH’s representation of the Montana Hospital Association and several of its individual member facilities. He also devotes considerable time to insurance defense and other general litigation claims, including large-scale class action litigation often involving thousands of potential class members. He also assists individual and corporate clients with intellectual property matters, including trademark registrations and infringement litigation.
Dan Auerbach moved with his family to Montana as a child, growing up largely in Missoula.
After high school, he obtained a bachelor’s degree in history from the University of Oregon. He also studied political theory and Spanish. He stayed at the University of Oregon to obtain his law degree and his MBA through a concurrent degree program. In law school, Mr. Auerbach obtained a certificate of completion in the business law program and was the co-founder of the Sports and Entertainment Law Forum. As a graduate student, he was admitted to the Warsaw Sports Marketing Center, one of a select few graduate programs emphasizing sports business, marketing, and finance. Following graduate school, he returned to Montana and joined BKBH in 2005. He is a partner and works in the firm’s Missoula office.
Mr. Auerbach enjoys spending time with his family, including his two sons, coaching youth sports, playing the piano, and enjoying Montana’s outdoors. He is active in the community through fundraising efforts for local organizations and serving on the boards of directors for multiple nonprofit organizations.
