Environmental, Natural Resources & Energy

Numerous environmental issues affect Montana’s businesses, including mining, oil & gas, and construction industries. Possible environmental issues include air and water quality permitting and compliance, hazardous and solid waste management and disposal, environmental impact statements and environmental assessments, and remediation of landfills and other contaminated sites. Our environmental law attorneys provide counsel for complying with all aspects of federal and state environmental statutes, including, but not limited to, the Clean Water Act, the Clean Air Act, the Endangered Species Act, and the Resource Conservation and Recovery Act, and for initiating and defending cost recovery actions under the state and federal superfund laws. Environmental permitting is also important in the construction law context for compliance with storm water discharge and runoff regulations.

We also help our clients prepare real property agreements and resolve property title and survey problems. BKBH is also experienced in assisting clients in obtaining reimbursement for cleanup costs associated with Underground Storage Tanks, from Montana’s Petroleum Tank Release Compensation Board. With our extensive environmental law and litigation capability, BKBH can provide experienced counsel for all environmental matters affecting past, present and future Montana property owners.
