Troy Bentson

As a senior attorney in BKBH’s Bozeman office, Troy Bentson has more than 20 years experience representing a wide array of clients in business transaction and litigation matters.  His litigation practice is focused on representing clients in matters concerning business and commercial transactions, real estate (including construction, development, and homeowner associations), labor and employment, and civil and commercial litigation.

Business & Commercial Transactions

Troy advises corporate clients on the appropriate business entities for meeting their goals and objectives and assists in the formation of limited liability companies, partnerships, and corporations.  He provides legal advice to businesses regarding operational matters, including matters concerning the preparation and upkeep of business records, contract and debtor/creditor disputes, purchases and sales of entities and assets, and various other matters faced by business owners.

Real Estate Law – Construction, Development, and Homeowner Associations

As a real estate lawyer, Troy represents individuals and businesses in a wide variety of real estate-related transactions and disputes.  His clients include buyers, sellers, developers, property managers, landlords, financial institutions, investors, real estate companies, and real estate agents.  He is experienced in all types of commercial transactions, ranging from purchase agreements and landlord/tenant issues to large mixed-use development matters.

Troy’s construction and development legal practice involves advising and representing construction industry participants, including owners, developers, general contractors, and subcontractors.  He reviews construction contracts and manages disputes such as the adequacy of performance and construction liens, and assists developers in a wide variety of matters concerning commercial development.

As Montana HOA lawyers, Troy and the firm represent a number of homeowner association clients in all facets of their operations, including formation, dispute resolution, and collection.

Labor and Employment Defense and Counseling

Troy helps employers meet the complex legal, compliance, and human resource challenges common in the workplace.  He counsels clients on labor and employment matters involving applicants, employees, and former employees.  He also assists with state regulation compliance, employment agreement drafting, and employee benefit programs.

Civil & Commercial Litigation

Troy’s civil and commercial litigation practice involves both filing and defending lawsuits brought in Montana state and federal courts.  He has successfully represented individuals and businesses in numerous claims, including those involving real estate, construction, collections, employment, landlord/tenant, breach of contract, insurance subrogation, and many other matters.  When possible, Troy also works to expeditiously and cost-effectively resolve client conflicts in alternative dispute resolution forums, such as arbitration and mediation.
