Attorney Carlo Canty’s practice is focused primarily on defending physicians in medical malpractice lawsuits, defending physicians against patient complaints to Professional Boards and government agencies, and all aspects of litigation. Mr. Canty also specializes in protecting the rights of individuals and organizations in government and grand jury investigations and defending those accused of crimes in state and federal courts.
Carlo’s healthcare practice includes defending alleged medical malpractice suits, and other related proceedings and litigation, as well as advising physicians and healthcare professionals in the day-to-day operation of their businesses, issues regarding standard of care, legal duties and ethics, government regulation, compliance, insurance, and administrative law.
As part of his healthcare representation, Carlo’s focus is protecting the reputations, interests, and professional licenses of physicians facing lawsuits, complaints, disciplinary actions and possible license revocations.
Being sued for medical malpractice can create professional, economic, and personal hardship for physicians, hospitals, healthcare facilities, and other medical providers. When allegations of wrongdoing or negligence arise, Carlo is dedicated to aggressively representing his clients to prevent unfair and unjust outcomes. He works to not only defend the action but to win and obtain a defense verdict. His medical malpractice clients include physicians, physician assistants, nurses, nurse practitioners, dentists, mental health providers, hospitals, and other healthcare facilities and personnel.
Insurance Defense and Insurance Coverage
Insurance defense is a cornerstone of Carlo’s practice. He routinely is retained by major insurance companies, small and mid-sized insurers, self-insured companies, and risk retention groups in complex insurance coverage disputes, as well as to defend the interests of insureds. He is well-versed in insurance law and regularly provides successful representation in matters involving construction defects, environmental hazards, professional liability, products liability, employment, motor vehicle claims, FELA, and other general liability issues.
Grand Jury Investigations & Criminal
The Government’s decision to pursue criminal charges often hinges on what occurs during the investigation of an incident and grand jury proceedings. Consequently, some of the most important work Carlo does on a case takes place during this initial phase. Carlo advises clients under investigation or complaint regarding potential criminal charges and regularly represents individuals and companies in serious criminal matters, including white-collar, business, environmental, and other crimes.
A fourth-generation Montanan, Carlo is a Martindale Hubbell AV-rated defense trial lawyer originally from Butte. Following in the footsteps of his grandfather and both parents, Carlo earned his undergraduate degree with high honors from Carroll College in Helena. He earned his law degree at the University of San Francisco.
Carlo currently serves on the Board of Directors for the Montana Justice Foundation, a non-profit organization dedicated to providing equal access to justice by providing legal aid and pro-bono services to vulnerable members of the community. An appointed member of the Montana Supreme Court’s Civil Jury Instructions Advisory Commission, his trial work has been broadcast live nationwide on Court TV. Carlo is a partner at BKBH’s main office in Helena and coordinates the law firm’s charitable contributions.
Carlo and his wife have three sons. The Cantys enjoy fly-fishing and river trips, hunting, and long-distance trail running.
