Morgan Weber

Attorney Morgan Weber is a seasoned litigator and an integral member of BKBH’s Litigation Group.  Her practice is primarily focused on workers’ compensation defense where she represents clients with claims defense and adjustment and advises in risk management.  She also represents landlords in real estate disputes, assists loan servicers in post-foreclosure conflicts, defends businesses in insurance, employment, and general commercial matters, and advocates on behalf of clients in real estate disputes and litigation.

Workers’ Compensation

As a workers’ compensation defense lawyer, Morgan’s workers’ compensation practice is largely focused on defending self-insured employers, insurance companies, and third-party adjustors in complex workers’ compensation matters.  Her clients include Liberty Insurance, the Montana School Group Insurance Authority, the Montana Municipal Inter-Local Authority, and other businesses and insurers.

Morgan works to resolve claims efficiently and cost effectively, while ensuring that injured workers receive only what they are entitled to, and not one penny more.  When a fair and just resolution cannot be reached, she vigorously defends her clients before the Montana Workers’ Compensation Court.  Morgan has prevailed on summary judgment and at trial for her clients.

Employment Defense and Counseling

Employers are under pressure to develop new approaches to both prevent employment disputes and, when they arise, to resolve them in the most effective manner possible.  Morgan is at the forefront of developing strategies that accomplish both of these objectives, advising employers on procedures and developing handbooks to minimize legal exposure while tenaciously defending them against claims in court, arbitration, or before administrative agencies.  

Financial Services

Morgan assists loan servicers in various financial services transactions, including post-foreclosure matters.  She litigates disputed foreclosure actions in state, federal, and bankruptcy courts.

Insurance Defense

Morgan represents insurers, and self-insured employers in insurance disputes.  She additionally serves in this area as a mediator between the claimant and the insured, working to expeditiously and cost-effectively resolve claims.

Litigation

Morgan’s litigation practice encompasses a wide range of business and commercial disputes, including contract breaches and unfair trade practices claims.  When appropriate, she works to find creative solutions to disputes through negotiation and mediation, and if these avenues are not possible, she tenaciously represents companies at trial.

Public Housing and Landlord-Tenant Disputes

Morgan represents landlords in tenant disputes involving lease breaches and evictions.  She also advises on state and federal regulatory compliance.

Real Estate

Morgan’s real estate practice is focused on representing commercial and residential clients in lease disputes, often involving property boundaries, easements, and use, as well as disputes arising from buy-sell agreements concerning real property.  She is committed to seeking to achieve client objectives through negotiation whenever possible, or through litigation, when necessary.

Morgan is a native of Corvallis and a third-generation Montanan.  She attended Gonzaga University and studied abroad in Florence, Italy, before obtaining a bachelor’s degree in business administration with concentrations in international business and law and public policy.

Morgan attended Valparaiso University School of Law and received her degree in 2007.  After graduation, she worked for an insurance defense firm in California, before moving back to Montana to be closer to family and friends.  She has been with BKBH since 2010 and works in the Missoula Office.

In her free time, Morgan enjoys playing with her dog, taking road trips, skiing, cheering on the Zags, and spending time with friends and family.  She is active in the community, including participating in Kiwanis.
