Hospital and health care law generally constitutes a major portion of BKBH’s legal work in Montana. Our attorneys have more than 25 years of experience providing legal services for Montana’s hospitals, health care facilities and individual health care providers. We serve as the General Counsel to Montana Hospital Association, The Benefis Health System (Great Falls), St. Peter’s Hospital (Helena), and Northern Montana Hospital (Havre). We routinely provide legal services to many of Montana’s 40-plus Critical Access Hospitals. Finally, our attorneys were responsible for creating the Healthcare Law Section of the Montana State Bar association.

Representative Matters:

  • BKBH health care attorneys routinely provide ongoing legal counsel in connection with drafting and interpreting contracts and conforming business operations to corporate and nonprofit laws, and with employment-related issues such as compliance with the rules governing the Americans with Disability Act and workers’ compensation.
  • BKBH represented numerous health care clients before the Department of Insurance and State Auditor’s office to ensure proper compliance with the provisions of the insurance code and Montana’s securities laws as they relate to health care providers.
  • Our attorneys are experienced in complex multiparty health care litigation involving representation of both plaintiffs and defendants. In the arena of health care law, we have handled medical malpractice, commercial, environmental, toxic exposure, and general civil cases, and we have advised and represented health care clients in criminal investigations and litigation related to their potential exposure to civil liability.
  • BKBH attorneys routinely review and draft employment agreements with physicians to ensure a health care provider’s exposure to tort liability for the acts of its employees is limited and to ensure the agreement is appropriately characterized as an employment agreement or an independent contractor agreement as the situation dictates.
