Representative Cases

  • Wrigg v. L&H, LLC, et al. (Mont. 2006). This was a premises liability case where BKBH represented the defendant bar owner.  BKBH obtained summary judgment in premises liability/assault case where plaintiff could produce no competent evidenceBKBH prevailed on a summary judgment in the district court, and that judgement was affirmed by the Montana Supreme Court (Case Number 2006 MT 338N).
  • Gehring v. State of Montana, et al., (Mont. 2006) (District court’s dismissal of plaintiff’s state constitutional claims against the City of Helena and other defendants affirmed).
  • Fleming v. International Paper Co., (MTWCC 2006) (Workers’ compensation court dismissed plaintiff’s asbestosis/occupational disease complaint on limitations grounds).
  • Flesch v. McDonald’s Restaurant, et al., (Mont. 2005) (District court’s imposition of dismissal sanction and summary judgment for defendants affirmed in premises liability case).
  • Radi v. McDonald, et al., (9th Cir. 2005) (District court’s award of defense summary judgment affirmed in 42 U.S.C. § 1983 action against Montana private prison and prison employees).
  • Cumberland Casualty & Surety Co. v. Preferred Contracting, Inc., (D.Mont. 2005) (Plaintiff surety company obtained $179,000 judgment against contractor based on surety contract).
  • Luther v. Eagles F.O.E. #16, (Dist. Ct. Mont. 2005) (Defendant landowner’s motion for summary judgment granted in premises liability, slip and fall case).
  • Huffar v. Crossroads Correctional Center, et al., (Dist. Ct. Mont. 2005) (Defendant prison’s motion to dismiss plaintiff’s 42 U.S.C. § 1983 complaint granted for repeated failures to effect service).
  • Wild v. Ridgeline Builders, Inc., et al. (Dist. Ct. Mont. 2005) (Defendant’s summary judgment motions granted on strict liability and loss of consortium claims in construction accident case).
  • Slicker v. Uninsured Employers’ Fund; H&R Energy, LLC, (MTWCC 2005) (Represented employer in workers’ compensation action which plaintiff voluntarily dismissed after his deposition taken and employer’s motion for summary judgment was filed).
  • D. Richard Pegg v. Erik Little, et al., (Mont. 2004) (District court granted defendant’s motion to compel plaintiff to comply with favorable oral settlement in lumber sale dispute. Montana Supreme Court dismissed plaintiff’s appeal on procedural grounds).
  • Montana Society of Anesthesiologists v. State Board of Nursing / Montana Association of Nurse Anesthetists, (Dist. Ct. Mont. 2004) (Represented intervener nurse anesthetists in successfully obtaining summary judgment in action involving board of nursing rules involving nurse supervision requirements).
  • Peters v. Matador Cattle Co., Inc., (Dist. Ct. Mont. 2004) (District court awarded summary judgment on statute of limitations and statute of frauds grounds in real property dispute over historical and current leases of ranch land).
  • Pallister Plumbing v. Case v. Homesure Services, Inc., (Just. Ct. Mont. 2004). (Court granted home warranty service company’s motion objecting to joinder in case involving warranty and consumer protection allegations).
