Stanley T. Kaleczyc

Bio

Mr. Kaleczyc is a graduate of the University of Pennsylvania and the George Washington School of Law. He is a founding shareholder in Browning, Kaleczyc, Berry & Hoven, P.C. Prior to establishing his law practice in Montana, he was Associate General Counsel of the Chamber of Commerce of the United States.  He has been listed in Super Lawyers of the Mountain States since 2008 and has been recognized by Chambers since 2007 in the area of commercial litigation.

Mr. Kaleczyc has extensive experience in a wide variety of business, legislative, and regulatory matters, representing client interests before the United States Congress, the Montana Legislature, and before state and federal courts including the United States Supreme Court, and federal and state administrative agencies.

Mr. Kaleczyc's principal areas of practice include commercial litigation , business law, insurance defense, insurance and securities regulatory matters, and administrative proceedings.  He has also served as counsel to clients in disputes involving federal and state tax matters, including property tax disputes for industrial clients and disputes over the allocation and apportionment of income of corporate income taxpayers.

Mr. Kaleczyc currently serves as the co-chair of his firm's Commercial Group.

He serves as  general legal counsel to the Montana Municipal Interlocal Authority, the interlocal government pool for liability, workers’ compensation, property and health coverages for Montana cities and towns.  He also is general legal counsel to the Montana Schools Group Insurance Authority, the workers' compensation, property and liability self-insurance program for Montana school districts.

From 1993 to 2000 State Auditor and Insurance Commissioner Mark O'Keefe appointed Mr. Kaleczyc as Special Deputy Liquidator for Glacier General Assurance Company in Liquidation.

Representative Matters

•    Representing Debtor-in-Possession in proceedings pending in Bankruptcy Court and Montana District Court in a complex dispute related to the terms, conditions, and obligations existing under loan documents related to a $200 million financing of a four season luxury ski and golf resort.
•    Representing a national mortgage lender in a putative class action concerning borrower paid mortgage insurance.
•    Defending a large natural gas producer in a putative class action for oil and gas royalty payment alleged to be in excess of $5 million.
•    Successfully concluded property tax protests for two successive tax years on behalf of the owner of industrial property.
•    Defended a major utility in class action litigation brought by shareholders of a company seeking $3 billion in damages with a settlement resulting in a recovery by our client.
•    Obtained dismissal on behalf of members of a tribal government in lawsuits challenging the validity of tribal elections and alleging violation of RICO and other federal statutes.
•    Represented a major utility in connection with an application to rate base interest in a coal fired generation facility at its fair market value of $407 million.
•    Represented officers of publicly traded company in a class action law suit alleging breaches of duties owed to investors.
